ELIGIBILITY: The “Where In The Flavor” program is offered and open only to legal residents of the United States who are at least 18 years of age as of the date of entry. By participating, each entrant agrees to these Official Rules and the decisions of the Sponsor which are final and binding in all matters. Void where prohibited. Employees of the Sponsor, its advertising or promotion agencies, those involved in the production, development, implementation or handling of the Sweepstakes, and agents acting for, or on behalf of the above entities, their respective parent companies, officers, directors, subsidiaries, franchisees, affiliates, licensees, service providers and any other person or entity associated with the Sweepstakes and/or members of their immediate families (spouses, children, siblings, parents) and/or persons living in the same household as such persons, whether or not related, are ineligible to participate in the Sweepstakes.

SPONSOR: The Sweepstakes is sponsored by Polar Beverages, 1001 Southbridge Street, Worcester, MA 01610 (the “Sponsor”).

AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrants’ full and unconditional agreement to and acceptance of these Official Rules and any decision of the Sponsor, which is final and binding. Winning a prize is contingent upon compliance with these Official Rules and fulfilling all other requirements set forth herein.

SWEEPSTAKES PERIOD: The Sweepstakes begins on November 24, 2024 at 8:30PM (EST) ends December 15, 2024 at Midnight (EST). The Sponsor’s Promotion computer is the official timekeeping device for the Sweepstakes. Entries that are submitted before and after the Sweepstakes Period will be disqualified.

HOW TO ENTER: Valid entry must satisfy the following actions:
(1) Participant complete the form located at https://polarseltzer.com/where-in-the-flavor/

(2) Participant must follow Polar Seltzer Instagram Account(@PolarSeltzer) , Facebook Account (@PolarSeltzer) or TikTok Account (@DrinkPolar)
(3) Participants must “LIKE” the associated social media post.

PRIZE DRAWING: The winner will be selected on or about 5 days after Sweepstakes closes. The Sponsor will select potential winners based on the following criteria: (1) Accuracy of the submission based on the official US Postal mailing address of the selected grocery store (2) Should all participants submit incorrect entries that are perceived to be equally inaccurate the Sponsor will randomly select a winner. (3) Should there be multiple entries with equivalent levels of proximity to the secret grocery store location the Sponsor will refer to the participant’s engagement with Sweepstake social media posts. The most engaged participant will be select. Otherwise a winner will be selected randomly.

WINNER NOTIFICATION: The Sponsor will attempt to notify the potential winner via direct message and as a comment below the their social media post and via the email submitted to the PolarVIP Mailchimp list. If the potential winner of the first (1st) drawing cannot be contacted within two (2) days after the date of the first attempt the Sponsor may select an alternate potential winner in his/her place at random from the remaining non-winning eligible entries. Only two (2) alternate drawings will be held, after which any remaining prizes will not be awarded. If the potential winner of the second (2nd) drawing cannot be contacted within one (1) day after the date of the first attempt the Sponsor may select an alternate potential winner in his/her place at random from the remaining non-winning eligible entries. If the potential winner of the third (3rd) drawing cannot be contacted within one (1) day after the date of the first attempt the Sponsor may select an alternate potential winner in his/her place at random from the remaining non-winning eligible entries. All Potential winners are subject to verification by the Sponsor, whose decisions are final and binding in all manners related to the sweepstakes. An entrant is not a winner of any prize unless and until the entrants eligibility has been verified and the entrant has been notified that verification is complete.

GENERAL CONDITIONS: If the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including but not limited to fraud, virus, bug, worm, unauthorized human intervention, or other technical problem, or in the event the Sweepstakes is unable to run as planned for any other reason, as determined by the Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of the Official Rules or (b) terminate the Sweepstakes and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process of the operation of the Sweepstakes, or to be acting in violation of these Official Rules. Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys fees) and any other remedies from any such person to the fullest extent permitted by the law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, entrants agree to release the Sponsor, and each of its parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Sweepstakes, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim, any damages whatsoever, including but not limited to punitive, consequential, direct or indirect damages or any cause of action arising out of participation in the Sweepstakes or receipt or use of the Prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or tower connections, availability or accessibility or miscommunication or failed computer, satellite, telephone, cellular tower or cable transmissions, lines or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic. Computer, human, printing or typographical errors (d) application downloads (e) any other errors or problems in connection with the Sweepstakes, including without limitation, errors that many occur in the administration of the Sweepstakes, the announcement and/or notification of the winner, the cancellation of postponement of the event, if applicable the incorrect downloading of the application or in any Sweepstakes-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, or alleged to be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or any equipment or programming associated with or utilized in the Sweepstakes.

DISPUTE RESOLUTION/CHOICE OF LAW: Except where prohibited, each entrant agrees that: (A) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court or the appropriate State Court located in Massachusetts (B) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Promotion, but in no event attorneys’ fees; and (C) under no circumstances will Entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Released Parties in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Massachusetts or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Massachusetts.
